The Virginia Graeme Baker Pool and Spa Safety Act requires anti-entrapment drain covers on public pools. Learn how this law protects swimmers.
The VGB Pool and Spa Safety Act
Drain safety is an important part of operating a public pool or spa. The Virginia Graeme Baker Pool and Spa Safety Act, passed in 2007, requires anti entrapment drain covers on public pools and spas. The requirement applies to these shared facilities, where drain covers are one of the specific safety features that operators need to account for.
For a facility manager, drain covers belong on the list of items to keep in view alongside the rest of the pool’s operating and maintenance needs. A maintenance plan should make clear what work is included, how equipment concerns are handled and who is responsible for the facility’s operating duties.
Regulations for commercial facilities
In Southern Nevada, the Southern Nevada Health District oversees permitted aquatic facilities. Pool service companies working at these facilities must be registered with the Health District, and qualified operators must hold a national pool operator certification. These requirements are separate from the day to day maintenance work needed to keep a facility operating.
Water testing is another regular responsibility. The CDC notes that clear water can still carry germs, which is why appearance alone is not enough to judge water quality. Its guidance calls for a pH between 7.0 and 7.8, with free chlorine at least 1 ppm in pools and at least 2 ppm when cyanuric acid is used. Hot tubs call for at least 3 ppm free chlorine and should not exceed 104°F. High cyanuric acid, which can build up through the use of tablets, makes chlorine work more slowly. Lowering a high level requires a partial drain.
Drain safety in residential backyards
The rules for public pools are not the same as the requirements for every residential backyard. Southern Nevada pool barriers follow a regional standard requiring gates to be self closing and self latching. That is a separate consideration from the federal drain cover requirement for public pools and spas.
Residential pool and spa work performed for a fee also requires a Nevada contractor’s license under NRS 624.920. Classification A-10e, described in NAC 624.150, covers maintenance and repair of pools and spas, including pumps, filters, heaters, timers, controls and lights. Homeowners arranging paid repair work can use the license classification to understand the scope of work it covers.
How Kingfisher Pool & Spa helps
We serve commercial pools and spas, including HOA and community pools, apartment and condominium pools, small hotels and motels, gyms, school pools and municipal facilities. We are registered with the Southern Nevada Health District for service at permitted aquatic facilities, and every technician on our commercial accounts holds the Certified Pool & Spa Operator certification.
Our process begins with a facility assessment, followed by a defined scope and written proposal, account onboarding, scheduled service and records. Depending on the facility’s needs, our work includes scheduled maintenance, water testing, chemical logs, equipment service and repairs, along with seasonal startups and closings. We do not replace a facility’s own qualified operator duties unless that responsibility is part of our contract.
For repairs, we provide a written estimate before work begins, and nothing extra is done without the customer’s approval. Our repair diagnostic visit is $85, credited in full toward the repair when it is approved within 30 days. We also hold Nevada contractor license 0000000, classifications A-10 and A-10e, for the work covered by those classifications.
